These Terms of Service (“Terms”) govern your access to and use of radien.ai and getsentrik.com and any content on them (together, the “Sites”). The Sites are operated by Sentrik Inc., a Delaware corporation (“Sentrik,” “we,” “us,” “our”). Radien is a brand of Sentrik Inc.
By accessing or using the Sites, you agree to these Terms. If you do not agree, do not use the Sites.
If you are using the Sites on behalf of a company or other organization, you represent that you have authority to bind it, and “you” refers to that organization.
The Sites describe our products and capabilities. Nothing on them is an offer to sell, a binding commitment, a warranty, a guarantee of any outcome, or professional advice of any kind — legal, regulatory, financial, compliance, or security.
Any use of Radien products or services, including a Merchant Deal Replay, an evaluation, a pilot, or a production deployment, is governed solely by a separate written agreement between you and Sentrik. If anything in these Terms conflicts with that agreement, the agreement controls.
Product descriptions on the Sites reflect our current design intent and may describe features that are in development, in limited release, or planned. They may change without notice, and we do not commit to delivering any particular feature, roadmap item, or capability.
Statements about what our products are designed to do describe design objectives and intended behavior. They are not promises that any specific outcome will occur in your environment. Product performance depends on your configuration, your policies, the data and thresholds you supply, the systems you connect, and factors outside our control.
Statistics, research findings, and third-party data cited on the Sites are attributed to their sources. We believe they are accurately reported, but we do not independently verify third-party research and are not responsible for its accuracy.
The Sites and all content on them — text, graphics, layout, design, code, logos, and the arrangement of all of it — are owned by Sentrik or its licensors and are protected by copyright, trademark, patent, trade secret, and other laws.
RADIEN, SENTRIK, and the associated logos and wordmarks are trademarks of Sentrik Inc. You may not use them without our prior written permission, except for nominative references that accurately identify us.
Certain technology described on the Sites is the subject of pending patent applications. Nothing on the Sites grants you any license or right under any Sentrik patent, copyright, trademark, trade secret, or other intellectual property, whether by implication, estoppel, or otherwise.
You may view and use the Sites for your own internal business evaluation purposes. You may not:
References on the Sites to third-party organizations — including financial institutions, research firms, regulators, and standards bodies — are for identification and informational purposes only. Where we describe an advisor’s prior experience at a firm, that identifies the individual’s background. It does not indicate any affiliation with, endorsement by, sponsorship by, or approval from that firm. No regulator or research organization named on the Sites endorses Sentrik or Radien.
The Sites may link to third-party websites and services. We do not control them, do not endorse them, and are not responsible for their content, practices, or availability. Your use of them is governed by their terms.
If you send us a message, booking request, question, suggestion, idea, or other feedback through the Sites, you grant Sentrik a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose, including improving our products, without obligation or compensation to you.
Do not send us confidential information through the Sites. Information you submit through the Sites is not treated as confidential unless a signed confidentiality agreement covers it. If you need to share confidential material, ask us for a mutual non-disclosure agreement first at hello@radien.ai.
You are responsible for the accuracy and legality of anything you submit, and you represent that you have the right to submit it.
By submitting your contact details, you agree that we may contact you about your inquiry and about our products. You can opt out of marketing messages at any time using the unsubscribe link in any marketing email or by writing to hello@radien.ai. We will still send you messages necessary to respond to your inquiry or administer a business relationship.
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
THE SITES AND ALL CONTENT ON THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SENTRIK DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT ANY CONTENT IS ACCURATE OR COMPLETE, OR THAT ANY DEFECT WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, SENTRIK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.
You agree to indemnify, defend, and hold harmless Sentrik and its officers, directors, employees, and agents from any claim, demand, loss, liability, damage, or expense, including reasonable attorneys’ fees, arising out of your use of the Sites, your violation of these Terms, or your violation of any law or third-party right.
You may not access or use the Sites if you are located in, or are a national or resident of, any country subject to comprehensive U.S. sanctions, or if you appear on any U.S. government restricted-party list. You agree to comply with all applicable export control and sanctions laws.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Sites will be brought exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction and venue.
We may revise these Terms at any time. Changes take effect when posted, and we will update the “Last updated” date. Your continued use of the Sites after a change means you accept the revised Terms. If you do not agree, stop using the Sites.
If any provision of these Terms is found unenforceable, the rest remain in effect and the unenforceable provision will be modified to the minimum extent necessary. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Sentrik regarding the Sites, and supersede any prior understandings on that subject. Sections 4, 6, 7, and 9 through 13 survive any termination.
